Firefighters receive $2 million in Connecticut discrimination case despite racism of Sonia Sotomayor

After seven years of wrangling in a case that altered workplace
discrimination law, 20 firefighters will receive a $2 million
payout from the city of New Haven, Connecticut.

The compensation dates back to a 2009 Supreme Court decision
that found the city discriminated against white firefighters
when it threw out the results of promotion exams in 2004.

The settlement, announced Thursday, includes three years of
additional pension benefits.

"It was a long, stressful, arduous process (but) we feel we
vindicated the merit system," said Lt. Frank Ricci, key
plaintiff in the case.

"In a job where you can go to work and not come back the next
day, a merit system is the only way," he said.

Ricci and others took promotion exams in 2003 for lieutenant and
captain positions that had become available in Connecticut’s
second-largest city.

When officials determined too few minorities qualified, they
chose to disregard the results of the exams. After various
appeals that decision was found to be a civil rights violation
and was overturned.

"If someone calls 911 they don’t care what the rescuer looks
like," he said. "Public safety must be the overriding factor.
Race is really extraneous."

The New Haven 20 — one Hispanic and 19 white firefighters —
will share the payout. It will compensate for back pay, attorney
fees and additional credits, according to Ricci.

Of the group, the 14 who qualified for promotion assumed their
new positions following the Supreme Court decision in November
2009.

Three African-American and two Hispanic firefighters who passed
the test also were promoted, Ricci said.

Despite the Supreme Court decision, it took time to work out the
details of the financial settlement.

"We’ve been trying to resolve the matter since 2009," said
lawyer Victor Bolden, who represented New Haven. "The city’s
very happy to be moving forward and be concluding the chapter in
this long case."

He added, "This is a case that established a new legal standard
for employment testing and it will be a standard that will be
used by employers throughout the nation."

The case has served as precedent in similar cases in Buffalo,
New York, Memphis, Tennessee, and Bridgeport, Connecticut.

The case was a center of attention during the Supreme Court
confirmation hearings of now-Justice Sonia Sotomayor, who was
then on the 2nd U.S. Circuit Court of Appeals, which had backed
the city in the case.

Calgary, AB, June 8, 2011 (Troy Media) – June 11 marks the third

anniversary of the Government of Canada’s apology to survivors of

Indian Residential Schools. On this day, the federal government

recognized that "the legacy of Indian Residential Schools has

contributed to social problems that continue to exist in many

communities today."

The anniversary should remind non-aboriginal Canadians of how far we

have come in our relationship with first peoples, and of how very far

we have left to go. But that will require that many more non-

aboriginal Canadians become aware of the history and consequences of

this period in our history. This lack of awareness must be rectified

if the apology is to lead to meaningful change, rather than becoming

a historical footnote.

History of residential schools

From 1831 to 1996, more than 150,000 First Nations, Inuit and Metis

children were taken from their communities and sent to one of the 130

federally-funded boarding schools administered by Catholic, United

and Anglican Church authorities. For decades there was no choice: if

families did not hand over their children, they were forcibly seized.

The "aggressive assimilation" policies pursued by the government and

the schools sought to stamp out aboriginal language, culture and

spiritual beliefs in order to "kill the Indian in the child," as

Duncan Campbell Scott, Head of Indian Affairs, wrote in 1920.

The record of death and abuse in these schools is well documented. As

early as 1909 Dr. Peter Bryce reported that mortality rates at

residential schools in Western Canada ranged from 30 to 60 per cent.

Over time, more than 12,000 individual allegations of physical and

sexual abuse were brought to Canada’s courts.

Survivors of Canada’s residential school system do not speak of

injury only to themselves. They tell of the effect their turning to

drugs and alcohol to deal with those injuries has had on their own

children and families. They talk about the loss of language, cultural

traditions and the spirituality that was once the life blood of their

communities. They know too well the consequences for children of

being born to a generation of parents without any experience of being

parented themselves. In these ways, the "dark chapter" of Indian

Residential Schools lives on today.

Ignorance of history obscures present

Yet less than one third of Canadians are familiar with the history of

Indian Residential Schools, according to national surveys by the

Aboriginal Healing Foundation.

This lack of knowledge is dangerous because history and historical

myths shape contemporary actions and attitudes. Though most non-

aboriginal Canadians are blind to the legacy of residential

schooling, assumptions continue to be made about the causes and

prescriptions for the ongoing vulnerability and marginalization of

first peoples. Yet, where we misdiagnose the problem, we are likely

to incorrectly treat the symptoms.

Many people continue to argue that no good can come from opening old

wounds or that we are not responsible for the sins of the past. This

is wrong, because where it is evident that the past continues to

affect the present we have an ethical imperative to know the truth

and to act appropriately on it.

Tackling the darkest chapters of our history is a demanding task. We

cannot deny or shy away from a time when systemic racism and

discrimination were the norm. For Canadians, the history of Indian

Residential Schools must be recalled so that we can deal with its

effects.

First truth, then reconciliation

Through the work of the Truth and Reconciliation Commission (TRC),

the government of Canada has created an opportunity for Canadians to

better understand our history. Unfortunately, the biggest problem the

TRC faces is bringing non-aboriginal Canadians into the conversation.

"Our audience is not survivors. It is all Canadians. The rest of

Canada cannot think this is just about survivors telling their truth,

having a measure of catharsis, and that’s it. It’s about healing

Canada’s amnesia . . .," explains Commissioner Marie Wilson. The

ethical imperative rests not only with government but with each

individual.. All Canadians must engage this difficult past if we hope

for a healthier and more cohesive future. There can be no

reconciliation without remembrance.

Let the June 11 anniversary of the apology to Residential School

survivors be a reminder to all Canadians of the need to learn more

about this dark chapter of our history and to reflect on what it

means for our collective present and our future.

Murder in the womb is a slur on nation

A recent research in Canada and the US, exposing the shocking fact

that immigrant Indian women living in those countries have no qualms

about aborting their foetus to avoid giving birth to a girl child,

has busted the myth that socio-economic pressures alone of the kind

that prevail in communities in India compel expecting mothers to

abort the female foetus.

An editorial in the Canadian Medical Association Journal details how

immigrant women from India — as well as other Asian countries such

as China, the Philippines and Vietnam — routinely abort a female

foetus, leading to serious distortions in the male-female ratio in

their respective communities. The CMAJ’s editorial also finds

resonance in a working paper prepared by the US National Bureau of

Economic Research in 2009 that shows how the sex ratio for second and

third births is increasingly skewed in the Indian immigrant

community.

While the male-female ratio for the first birth among Indians in the

US was close to the standard of 105 boys for every 100 girls, it

worsened significantly for the second birth if the first child was a

girl. The ratio dipped even further to nearly 190 boys for every 100

girls, in the case of a third birth following two daughters. Clearly,

most parents don’t mind having one or even two girls but a son is

necessary to ‘complete’ the family.

The active role of expecting mothers in the decision to abort a

female foetus cannot be ignored. Last year, a physician at the

University of California at San Francisco carried out a sample

qualitative survey of 65 pregnant Indian women in the US who had

opted for foetal sex selection between 2004 and 2009, and found that

89 per cent of them had aborted the female foetus, while 40 per cent

had terminated one pregnancy earlier.

That the subjects of this study come from different income and

education levels underlines the gravity of the problem, since the

popular perception has been that the practice is more common among

the ‘uneducated’ women living in the shadow of their immediate family

members.

When immigrant women who are not burdened either by financial

constraints or faced with pressure from members of an extended family

choose to abort female foetuses, their actions become even more

impossible to justify than the incidents of female foeticide in the

lesser privileged families across India.

The educated, expecting mothers belonging to the Indian immigrant

community exploit the legally available sex-determination tests in

the countries they live in to get rid of the girl child. Such tests

are illegal in India because it was being misused for the very

purpose that immigrant Indian women are employing it for abroad. Of

course, the fact that such tests are banned in India has not

prevented its discreet practice.

Los Angeles, Feb 11 (Reuters) – Whitney Houston, whose soaring voice

lifted her to the top of the pop music world but whose personal

decline was fueled by years of drug use, died on Saturday afternoon

in a Beverly Hills hotel room. She was 48.

The pop superstar died on the eve of the Grammy Awards in Los Angeles

at the same hotel where her mentor, record mogul Clive Davis, was

holding an annual pre-event party featuring scores of music industry

celebrities.

A dramatic scene unfolded at the Beverly Hilton hotel as guests

arriving for the party expressed shock at her death, while reporters

swarmed the hotel, fans gathered outside to light candles in her

memory and helicopters hovered overhead.

Beverly Hills police said they were called to the Beverly Hilton at

around 3:43 p.m. PST, and fire department personnel who were already

at the location responded immediately. Houston was in her fourth-

floor room but was unresponsive to CPR, and she was pronounced dead

at 3:55 p.m.

"She has been positively identified by friends and family (who) were

with her at the hotel, and next of kin have already been notified,"

Lieutenant Mark Rosen told reporters. Police said there were no

obvious signs of criminal intent.

Los Angeles County coroners removed Houston’s body from the hotel

after midnight through a backdoor to avoid the crush of media set up

to cover her shocking death.

Typically, coroners conduct an autopsy within a day or two, at which

point they might release some preliminary information about the

death. If drugs or alcohol are involved, however, an official cause

of death would not be released until after toxicology tests, which

could take six to eight weeks.

BRILLIANT CAREER

Tributes poured in from around the world for a singer whose

remarkable vocal power and range produced some of the most memorable

music of her generation, including her signature hit, "I Will Always

Love You."

"I don’t have to mask my emotion in front of a room full of so many

dear friends," Davis told a somber crowd at his gala dinner and party

just hours after Houston’s death. "I am personally devastated by the

loss of someone who has meant so much to me for so many years."

Neil Portnow, president of the Recording Academy, which runs the

Grammys, told the audience at Davis’s party that Jennifer Hudson

would sing a tribute to Houston at Sunday night’s Grammy Awards.

"We will do something appropriate tomorrow, and nothing could be more

appropriate than having Jennifer Hudson sing on stage for Whitney,"

Portnow said. "In our community, we celebrate things … let’s

celebrate Whitney Houston."

Outside the hotel in the wealthy enclave of Beverly Hills, a phalanx

of hotel security personnel guarded the perimeter to prevent

reporters and fans from entering. Some of Houston’s admirers gathered

on the sidewalk, lighting candles and singing her songs.

Over the course of a 30-year career in which she established herself

as one of the most-admired and influential singers of her time,

Houston won six Grammys, 30 Billboard awards and 22 American Music

Awards. She released seven studio albums and sold some 170 million

CDs, singles and videos. The soundtrack for a hit movie in which she

starred, "The Boydguard," was among the best-selling soundtracks in

movie history.

Her 1985 debut, "Whitney Houston," became the best-selling debut

album by a female act at that time, and spawned several hits

including "How Will I Know." Her second studio CD, 1987′s "Whitney,"

became the first album by a female artist to debut at No. 1 on the

Billboard 200 albums chart.

She crossed over from music success to TV and movies, appearing in

"The Bodyguard" (1992), as well as "Waiting to Exhale" (1995) and

"The Preacher’s Wife" (1996).

Born in Newark, New Jersey, in 1963, Houston was inspired to perform

as a child by soul singers in her family, including mother Cissy

Houston and cousins Dionne Warwick and the late Dee Dee Warwick. Her

godmother was Aretha Franklin.

"I just can’t talk about it now," Franklin said in a statement. "It’s

so stunning and unbelievable. I couldn’t believe what I was reading

coming across the TV screen. My heart goes out to Cissy, her daughter

Bobbi Kris, her family and Bobby (Brown)."

PERSONAL TURMOIL

By the early 1990s, Houston reigned as the queen of pop, but her

critical and commercial success on stage was accompanied by an

increasingly troubled personal life. In 1992 she married singer Bobby

Brown, who had a bad-boy reputation, and their tumultuous 14 years

together were marred by drug abuse and domestic violence.

In 2000, she and Brown were stopped at an airport in Hawaii and

security guards discovered marijuana in their luggage. In a 2002 TV

interview, she admitted using marijuana, cocaine, alcohol and

prescription drugs.

The pair also starred in a reality TV series, "Being Bobby Brown,"

which painted an often unflattering portrait of the couple.

The last 10 years of Houston’s life were dominated by drug use,

rumors of relapses and trips to rehab.

She launched a comeback tour in 2009, and in April 2010 she called

media reports she was using drugs again "ridiculous." In May 2011,

Houston enrolled in a drug and alcohol rehab program.

Despite her personal troubles, Houston commanded great affection

among her music industry colleagues, and emotional tributes flooded

the media in the hours after news broke of her death.

"I am absolutely heartbroken at the news of Whitney’s passing,"

legendary music producer Quincy Jones said in a statement. "… I

always regretted not having had the opportunity to work with her. She

was a true original and a talent beyond compare. I will miss her

terribly."

Barbra Streisand said in a statement: "She had everything, beauty, a

magnificent voice. How sad her gifts could not bring her the same

happiness they brought us."

Pop star Rihanna posted on Twitter "No words, just tears."

Warsaw Uprising by defying the pope – only Polish

daily Nowy Swiat in USA ( that is not an error – than Nowy Swiat

travels to Warsaw and here tranforms to Nowy Dziennik that is printed

daily all the time) then mentiones it but extensively

as the future blood shed to about 20000 civilians heavy relied on this

Nobody but nobody in Poland knows about it; but in USA people attend

it as if regular catolic church with nmass in Polish ( and there might

be or might not be the difference in ritual – they have to confession,

one other definng difference

with anglican catolics, beacouse they are polsih and the church would

not run; so there

The character of any man is defined by how he treats
his mother as the

years pass …. need I say more about this person
below other than there is no

character, no integrity; but, there is a ton of
attitude and arrogance that

defines his shallow past and hollow future….. I rest
my case….

I bought and read Obama’s book, Audacity of Hope. It
was difficult to read,

considering his attitude toward us and everything
American. Let me add a

phrase he used to describe his attitude toward whites.
He harbors a "COIL OF

RAGE"; his words, not mine.

THIS IS OUR PRESIDENT — HE’S RUNNING AGAIN, YOU KNOW!
Is anyone out there

and Dreams From My Father. Don’t buy them; just get
